ARTICLE I Section 1. The name of this Association shall be the Associated Students of Diablo Valley College, hereinafter referred to as ASDVC.
ARTICLE II Section 1. The objectives of the ASDVC shall be: A. To unite students who are registered at DVC in one local organization. B. To advocate for various student interests and concerns. C. To act as a central clearinghouse for information relating to student governance and co-curricular interests being conducted at DVC, CCCC District and Statewide. D. To help formulate standards and principles for students in the community college and other sectors of education. E. To encourage legislation and public support of students in the community college and other sectors of education.
ARTICLE III Section 1. Any person enrolled as a student at DVC is considered to have basic membership in the ASDVC. Section 2. ASDVC BOARD OF PETITIONERS MEMBERSHIP Any registered student regardless of race, religion, sex, national origin, or physical limitation shall be declared a member of the Board of Petitioners after completion of the procedures set forth in the Administrative Policy on Petitioners (Blue Ribbon Report). This Administrative Policy shall include these pre-requisites: a. In order to become a member of the Board of Petitioners, a student must be in good academic and disciplinary standing within the Contra Costa Community College District. b. In order to become a member of the Board of Petitioners, a student must be officially enrolled in and maintain at least six (6) active units at DVC. These six (6) units must be academic units. c. A grade point average (GPA) of 2.0 must be maintained during Board membership. GPA and unit checks are made each semester. d. The ASDVC Petition for installment must be completed within the first twenty-one (21) days of the start of the fall and spring semesters and must solicit a total of two hundred and fifty (250) signatures of currently registered and enrolled DVC students. Verification of qualifications shall be documented before installment. Upon verification, the student becomes a member of the Board of Petitioners. e. Once accepted as a Board member, a member must have a current ASDVC sticker. The ASDVC sticker must be kept current during said membership on the Board. f. A member of the Board of Petitioners may not hold office concurrently in student government of another college or university, nor act in a manner against, or that does not comply with the ASDVC Constitution. g. Each member of the Board of Petitioners must serve as a representative to at least one College Committee or Task Force or an ASDVC Committee, including attending meetings and reporting back to the ASDVC Board. h. A member of the Board who drops below the aforementioned requirements will automatically be removed from his/her position as a board member, and will not be allowed to re-petition until the individual has completed a full regular semester while maintaining the aforementioned standards. i. Any Board member needing a leave of absence must submit their request in writing to the ASDVC President for total Board approval. If Board approved, the absent member must thereafter continue to keep informed on ASDVC business. Leaves of absences will be granted ONLY for a four (4) week period, and only for emergency situations. j. Each Board member must either renew an ASDVC sticker discount negotiated in the previous semester or acquire an ASDVC sticker discount with a new establishment. Failure to renew or acquire a new ASDVC sticker discount shall result in suspension of a Board member’s voting privileges in the following semester. Voting privileges shall be reinstated when a new ASDVC sticker discount is negotiated. k. Every Board member must attend all meetings and summits (other than Board meetings) deemed mandatory by the majority of the Executive Board or the Advisor. Board members will be notified of such meetings in person, by telephone, or in writing by an Executive Officer, Advisor, or Student Life Staff at least one week before the meeting(s) take place. Failure to attend such meetings will be subject to Board review and can include removal from the Board. 1. Such meetings can include, but are not limited to, retreats held at the start of the fall and spring semesters. 2. In order to be considered for board membership, the prospective board member must attend at least one (1) informational session offered during the current semester’s petitioning period. Section 3.
Successful petitioners
will serve on the Student Board for a maximum of 365 days per petition. Section 4. A student Board member whose petition expires after the first census week of a given semester will be permitted to serve on the board for the balance of that semester. Section 5. Every Board member can serve either as an officer, head of standing Board committee, representative on a college committee or assume such duties as so designated by the board. Section 6. The Board by 2/3 vote of its membership present shall have the power to appoint temporary Board members to function for a maximum of one 15 day term, plus an additional 15 day term, if so approved by the Board, while they are re-petitioning. Section 7. Any Board member desiring to resign from the Board shall submit a resignation in writing to the ASDVC President.
ARTICLE IV Section 1. a. The officers of the ASDVC Board shall be: President, Vice President for Executive Affairs, Vice President for Legislative Affairs, Controller, Secretary, Parliamentarian, Public Relations, Activities Coordinator, Inter Club Council Coordinator, Minority Affairs and Webmaster. These officers shall perform the duties prescribed by this Constitution and By-Laws. b. Order of Ranking Officers: President, Vice President for Executive Affairs, Vice President for Legislative Affairs, Controller, Secretary, Parliamentarian, Public Relations, Activities Coordinator, Inter Club Council Coordinator, Minority Affairs and Webmaster.
Section 2. QUALIFICATIONS, TERMS OF OFFICE, ELECTIONS, AND REMOVALS a. Terms of Office: Terms of office shall run from June 1st to May 31st of the school year. The ASDVC does not meet in summer. Actual months of office are August to May. b. Elections: 1. All Board elections shall be conducted by the ASDVC Board, with the exception of voting for the position of ICC Coordinator. Refer to Election Code By-Law for detail. 2. Qualifications: All candidates must be official recognized members of the Associated Students of Diablo Valley College (ASDVC Board of Petitioners). They must have met the ASDVC Constitution/By-Law requirements. 3. Nominations for candidates will be made beginning at the first ASDVC meeting in March and will be closed at the second meeting in March during the Spring semester. Only ASDVC Board members can make nominations. 4. All nominations must have a first motion, no second motion is required. A member wishing to second a nomination for the purpose of endorsement can do so. Individuals may nominate themselves. No person may be nominated or run for more than one ASDVC office in a given election. 5. In the event there are no candidates for ASDVC board positions, nominations for vacant positions will be held at the second official ASDVC meeting in the Fall semester. Elections for vacant Board positions will be held at the third ASDVC meeting. Only ASDVC Board members will vote for these candidates. No open elections will take place to fill vacant positions. 6. Those elected for these positions will hold office until the end of the Academic Year, if they remain eligible. Elections conducted by an ASDVC Board of Petitioners vote must be done according to the rules of the Brown Act. 7. By the time of the election, candidates nominated must be an official member of the ASDVC Board per Article III. For purpose of filling vacant Board positions, candidates must be official ASDVC Board members, but not necessarily eligible to vote. Failure to meet this qualification will result in disqualification of the candidate. 8. Elections will be held the week immediately preceding spring break. Polls will be open on Saturday and Monday and Tuesday. Locations of Polling Stations will be: Student Life Office, Diablo Valley College and the San Ramon Valley Center (SRVC). Hours will be Saturday 9:00 am to 1:00 pm, Monday/Tuesday hours are 9:00 am to 7:00 pm. Voting on Saturdays will occur only if there is Saturday school. Elections will take place even if there is only one candidate running for office. 9. Short Term Hourly persons will work election Polling Stations. The ASDVC will establish a budget each year for the expense. 10. The winning candidate(s) must receive a plurality of the votes cast for a given office(s). Plurality is defined as “The number of votes cast for a winning candidate, if this number is less than a majority but more than that cast for any other candidate.” No percentage or number quota will be used to validate an election. No write in or proxy voting is allowed. 11. In case of a tie between two candidates for an office, a Run Off election will be held. The date, and time, and campaigning rules, will be determined by the Election Committee, and will take place prior to the end of Spring semester. 12. The position of ICC Coordinator will be elected separately from the other officer positions. Candidates for ICC Coordinator will be nominated at the ASDVC Board meeting immediately preceding the first official ICC meeting of the Fall semester. All nominees must be ASDVC Board members at the time of nomination, but do not need to have voting status. All nominations must be made by ASDVC Board members. All nominations must have a first motion; a second motion is not required. A member wishing to second a nomination for the purpose of endorsement can do so. Individuals may nominate themselves. Nominated candidates will be voted upon by the officially designated ICC representatives of the individual campus clubs at the first official ICC meeting of the Fall semester. The winner shall be the candidate who receives a plurality of votes as defined above. In case of a tie vote, the tie breaking vote shall be cast by the individual acting in the role of ICC Coordinator to chair the meeting. c. Removals:

If a person is appointed to multiple committees and fails to attend one or more committees, he/she should be removed from the committee(s) s/he is not attending. If the board member is appointed to only one committee and fails to attend, s/he will be recommended for removal from the Board. 3. Revocation of membership shall be accomplished by a 2/3 vote of the majority of members present at a regularly scheduled meeting. Section 3 Officer Responsibilities A. PRESIDENT 1. Shall be the presiding officer of the ASDVC Board. 2. Shall prepare and post the ASDVC Board agenda with the designated Advisor. If the President is unable to attend the agenda planning meeting, his/her designee must attend. 3. Shall represent the ASDVC Board at Student Trustee Advisory Committee meeting and other such meetings requiring representation of the ASDVC. If the President is unable to serve at such meetings, he/she may appoint or ask the Board to select another person. 4. Shall promote the development of Executive Board policy, strategy, goals and objectives. 5. Shall supervise the implementation of Executive Board policy and promote ASDVC both on campus and in the community. 6. Shall appoint student representatives to campus committees. 7. Shall have the authority to create ad-hoc committees as necessary, and to appoint the chair of such committees. 8. Shall be an ex-officio member of all ASDVC Committees and see that such committees perform their duties expeditiously. 9. Shall, in conjunction with the Vice President for Legislative Affairs, develop a viable program of legislative activism at the local, state and federal level, and supervise its implementation. 10. Shall, in conjunction with the Vice President for Executive Affairs, post and maintain a minimum of ten (10) regular office hours per week. 11. Shall assist in publishing the ASDVC Annual Report. B. VICE PRESIDENT FOR EXECUTIVE AFFAIRS 1. Shall perform in the capacity of the President in case of his/her absence or inability to conduct the business of the ASDVC. 2. Shall work in conjunction with the President on the other duties related to ASDVC business.

until a new officer is elected, in the capacity of any vacant
ASDVC office. If one or more offices are vacant, the

will serve in the 4. Shall chair the ASDVC Election Committee and be responsible for conducting all ASDVC elections. If the Vice President for Executive Affairs is a candidate for next year’s Executive Board, he/she shall ask the Board to appoint another person. 5. Shall solicit student input (through suggestion boxes and other means), research complaints, and suggestions and present them to the Executive Board. 6. Shall serve as liaison between students on ASDVC committees and the Executive Board, reporting to the Executive Board important items discussed in ASDVC committees. 7. Shall appoint members to ASDVC committees after consultation with the President unless otherwise stipulated by this Constitution with majority approval of ASDVC. 8. Shall keep current committee appointments, agendas, minutes, and attendance logs. 9. Shall, in conjunction with all other Executive Officers, publish the ASDVC Annual Report, highlighting the Board’s accomplishments in the past academic year. All gathered information will be passed onto the succeeding Executive Board. 10. Shall, in conjunction with the Advisor, coordinate the implementation of all mandatory meetings and summits (i.e., retreats). 11. Shall serve as a member of the Budget Oversight Committee and chair the committee in the absence of the Controller. 12. Shall share an office with the President and assist him/her in maintaining regular office hours. 13. Shall perform other related duties as assigned by the President. C. VICE PRESIDENT FOR LEGISLATIVE AFFAIRS 1. Shall serve as the DVC delegate to the California Student Association of Community Colleges (CalSACC) if ASDVC is a dues paying member. If he/she is unable to attend all CalSACC meetings, his/her designee must attend. 2. Shall serve as the DVC delegate at community college associations, conferences, and meetings if ASDVC is a dues paying member or if ASDVC decides to send delegates to such events. If the Vice President for Legislative Affairs is unable to serve at such events, he/she shall ask the ASDVC Board to select another person or persons to attend. 3. Shall provide a weekly report to the Board on all legislative affairs that are relevant to DVC and the students. 4. Shall, in conjunction with the President and Advisor, develop a viable program of legislative activism at the local, state, and federal level, and implement such programs in a manner that best promotes the position of ASDVC in these matters. 5. Shall, after approval from the Board, draft all official ASDVC position statements. 6. Shall chair the ASDVC Legislative Committee. 7. Shall perform other related duties as assigned by the President. 8. Shall assist in publishing the ASDVC Annual Report.
D. CONTROLLER 1. Shall, under the direction of the campus designated Advisor, maintain monthly fiscal reports including: a. The ASDVC revenues and expenditures, with an emphasis on monitoring ASDVC sticker sales; b. Budgetary specifics as requested by the ASDVC Board and/or ASDVC Board members. 2. Chair the Budget Oversight Committee. 3. Shall prepare letters of agreement for recipients of ASDVC-allocated funds and follow up with recipients to ensure compliance with the proposal and deadlines. 4. Prepare the ASDVC Budget, with the guidance of the Advisor, before spring break and present it to the Board. 5. Shall assist in publishing the ASDVC Annual Report. E. SECRETARY
F. PARLIAMENTARIAN
G. MINORITY AFFAIRS OFFICER 1. Shall propose, in conjunction with the Activities Coordinator, ASDVC-sponsored diversity awareness activities each semester. 2. Shall work with other members of the campus community to increase awareness of the importance of diversity issues and their relationship to student success. 3. Shall chair the ASDVC Diversity Awareness Committee. 4. Shall assist in publishing the ASDVC Annual Report. H. PUBLIC RELATIONS OFFICER 1. Shall inform DVC’s Sister and Satellite Campuses, the media, other college campuses, the public, and the faculty and staff about the ASDVC and affiliated clubs. 2. Shall establish and maintain lines of communication with the DVC Director of Public Relations or equivalent. 3. Shall, in conjunction with the Advisor, work to disseminate information about and advertise ASDVC-sponsored events and activities to students, faculty, and administration via electronic means. 4. Shall chair the ASDVC Public Relations Committee. a. Shall edit and publish ASDVC’s newsletter, the Initiator, on an as-needed basis. 5. Shall make recommendations to the Board on the Campus Communications budget line. 6. Shall organize and submit content to the Webmaster for the ASDVC website. 7. Shall monitor all off-campus events that would be of interest to ASDVC and forward to appropriate ASDVC Board members. 8. Shall coordinate all ASDVC sticker discounts with vendors and maintain lists of students who have negotiated discounts. 9. Shall assist in publishing the ASDVC Annual Report. I. ACTIVITIES COORDINATOR 1. Shall maintain a monthly calendar of all club-sponsored and ASDVC events. 2. Shall organize and submit Board-sponsored activities for ASDVC Board approval. 3. Shall chair the ASDVC Activities Committee. 4. Shall be provided with student interns to assist with event organization and promotion at the discretion of the Advisor. 5 Shall assist in publishing the ASDVC Annual Report. J. INTER-CLUB COUNCIL COORDINATOR
K. WEBMASTER 1. The Webmaster shall maintain the ASDVC website under the direction of the ASDVC Board and the Advisor. 2. Shall chair the ASDVC Technology Committee. 3. Shall promote access to and work towards increasing participation in DVC elections. 4. Shall establish and maintain lines of communication with the DVC Dean of Technology or equivalent. 5. Shall attend all campus IT Committee meetings and report back to the Board. If the Webmaster cannot attend such meetings, his/her designee must attend. 6. Shall assist in publishing the ASDVC Annual Report and post the final report on the ASDVC website. L. DISTRICT STUDENT TRUSTEE
ARTICLE V Section 1. This ASDVC Board shall meet a minimum of two times a month. All meetings shall be open to DVC students, including SRVC students, faculty, staff and the public, and will be held in accordance with the Brown Act. Section 2. Special meetings may be called by the President, or at the request of the Advisor, or may be called by written request of the majority of the ASDVC Board members and/or Executive. Section 3. A majority of voting ASDVC Board members shall constitute a quorum for the transaction of business. Section 4.
In all matters of
ASDVC
Board voting, each member shall be entitled to one vote only. Voting shall
not be accumulative; and there shall not be any voting by proxy or absentee
ballot. New ASDVC Board members will not be allowed to vote until they have
attended
ARTICLE VI Section 1. The ASDVC Board shall have the power to establish policies and procedures regarding daily business in accordance with the philosophy and objectives stated in the Constitution and consistent with district, state and federal laws.
ARTICLE VII Section 1. The ASDVC shall maintain both standing committees and ad-hoc committees, and shall provide student representatives to college committees and task forces where necessary. Each ASDVC Board member must serve as a representative to either a college committee, task force or ASDVC committee. Voting privileges will be granted to DVC students who are not Board members if they attend 3 consecutive committee meetings, and one ASDVC meeting, and have an ASDVC sticker. Voting rights will not be given to students on Budget Oversight and Constitutional Committees.
1. ASDVC Legislative Committee: This committee tracks local, state, and national legislative issues that relate specifically to student issues. The committee is then tasked with bringing to the Board complete, unbiased reports of such legislation, and recommendations for ASDVC Board action. The committee shall research the need for DVC representation at conferences [and other summits where DVC decides to send delegates] and recommend the students to attend such conferences. 2. ASDVC Constitutional Committee: This committee regularly reviews constitutional issues and recommends amendments to the ASDVC Board. 3. ASDVC Diversity Awareness Committee: This committee plans activities to raise campus awareness of diversity issues. 4. ASDVC Public Relations Committee: This committee publicizes ASDVC events to the student newspaper, administration and off campus entities. The committee shall be provided with an advertising budget to create press releases, newspaper ads (both on and off campus), an ASDVC newsletter, and other items necessary to publicize ASDVC and ASDVC-sponsored activities. The committee shall also be responsible for designing and distributing all ASDVC promotional material to ASDVC Board members. 5. ASDVC Activities Committee: This committee develops and organizes ASDVC-sponsored activities and builds student interest in ASDVC activities by promoting such events on campus. The committee shall be provided with budget to purchase materials for on-campus advertising. 6. ASDVC Technology Committee: This committee assists the webmaster in updating the ASDVC website in collaboration with the ASDVC Public Relations Committee and ASDVC Activities Committee. 7. ASDVC Budget Oversight Committee: This committee develops and manages the ASDVC budget. 1. An ad-hoc committee is one that is not defined by the Constitution. Ad-hoc committees must be reinstated at the beginning of each school year, if necessary. 2. Ad-hoc committees must be announced and posted immediately after their creation. Such posting must list the committee charge, composition, meeting times, and dates. C. COLLEGE COMMITTEES AND TASK FORCES 1. Campus committees and task forces are created by DVC entities other than the ASDVC. When such campus committees have been announced, the ASDVC President shall bring the information to the ASDVC Board, including the composition, charge, meeting times and dates. 2. The student members of such committees shall be appointed in the same manner as for ASDVC ad-hoc committees. Such student representatives shall also make regular reports from their campus committee to the ASDVC. Any student representative to campus committees who does not maintain contact with the campus committee and the ASDVC can be removed from their position.
ARTICLE VIII Section 1. The rules contained in the current edition of ROBERT’S RULES OF ORDER, NEWLY REVISED shall govern the ASDVC in all cases to which they are applicable, consistent with the Constitution and By-Laws. In the absence of guidance in the Constitution and By-laws, Roberts Rules shall be used.
ARTICLE IX Section 1. This constitution can be amended by the Board by a 2/3 vote, and the approval of the President’s Council. Amendments must be submitted in writing and discussed at a previous regular meeting prior to a vote by the ASDVC Board.
